AGREEMENT TO OUR LEGAL TERMS

We are Blue Aurora Technologies LLC, doing business as Bobber Bargain (“Company,” “we,” “us,” “our”), a Pennsylvania company located at 1301 Alter Avenue, Tarentum, PA 15084, United States.

We operate https://bobberbargain.com (the “Site”) and related products/services that reference these Legal Terms (collectively, the “Services”).

These Legal Terms are a binding contract between you and Blue Aurora Technologies LLC. By accessing or using the Services, you agree to these Legal Terms. If you do not agree, do not use the Services.

We may update these Legal Terms from time to time. We will change the “Last updated” date when we do. Your continued use of the Services after an update constitutes acceptance of the revised terms.

Audience: The Services are intended for U.S. residents age 18+. Minors may not register or use the Services.

We recommend printing a copy of these Legal Terms for your records.

1. OUR SERVICES

The Services are offered to U.S. residents and orders are accepted only for U.S. shipping addresses (50 states and D.C.). We do not ship internationally. Access from other jurisdictions is at your own initiative and risk and must comply with local laws.

The Services are not designed to comply with industry-specific regulations (e.g., HIPAA, FISMA, GLBA). Do not use the Services where such laws would apply.


2. INTELLECTUAL PROPERTY RIGHTS

Our IP. We own or license the Services and all content therein, including source code, software, designs, text, photos, graphics, audio/video, and trademarks/service marks (collectively, “Content” and “Marks”). Content and Marks are protected by U.S. and international laws.

Your license. Subject to these Legal Terms, we grant you a revocable, non-exclusive, non-transferable license to access the Services and download/print permitted Content for personal, non-commercial use only.

Except as expressly allowed, you may not copy, distribute, publicly display, modify, or exploit the Services, Content, or Marks without our prior written consent. Requests: support@bobberbargain.com.

We reserve all rights not expressly granted.

Your submissions/contributions.

  • Submissions (e.g., feedback you send us): you assign all IP rights to us.

  • Contributions (content you post or submit through the Services): you grant us an unrestricted, perpetual, worldwide, royalty-free, transferable, sublicensable license to use, reproduce, distribute, display, perform, and create derivative works (including your name, image, voice, and logos where provided), in any media now known or later developed. You represent you have all rights necessary and that your Contributions do not infringe or violate any law or rights. We may remove or edit Contributions at our discretion.


3. USER REPRESENTATIONS

By using the Services, you represent and warrant that: (1) all registration information is true, accurate, current, and complete; (2) you will maintain and promptly update it; (3) you have legal capacity and agree to these Legal Terms; (4) you are 18 or older; (5) you will not use bots/automation to access the Services; (6) you will use the Services lawfully; and (7) you will not violate applicable laws or these Legal Terms.


4. USER REGISTRATION

You may need an account. Keep your password confidential. We may reclaim usernames at our discretion.


5. PRODUCTS

We strive to display product colors, features, specs, and details accurately; however, displays may vary and information may change. All items are subject to availability. We may discontinue products or change prices at any time.


6. PURCHASES AND PAYMENT

Accepted methods: Visa, Mastercard, American Express, Discover, PayPal, Apple Pay, Google Pay, Shop Pay, Meta Pay, Venmo (availability may vary).
You agree to provide accurate billing/shipping info and authorize us (and our payment processors) to charge all amounts due, including applicable taxes and shipping. All amounts are in U.S. dollars.

We may refuse or cancel orders; limit quantities per person/household/account/payment method/address; and decline orders we suspect are for resale. Orders to freight forwarders/reshippers may be canceled.


7. RETURN/REFUNDS POLICY

See our Return & Refund Policy posted on the Services. U.S. orders only; RMA required; eligibility and timelines apply.


8. PROHIBITED ACTIVITIES

You may not misuse the Services, including: scraping or compiling data without permission; defeating security; harassing others; uploading malware; automated access; IP infringement; impersonation; unlawful conduct; or abusing support. We may take appropriate action, including account suspension and reporting to authorities.


9. USER GENERATED CONTRIBUTIONS

Contributions must comply with law and these Legal Terms (e.g., no infringement, defamation, hate, obscenity, illegal content, privacy violations, or spam). You must have all necessary consents and rights.


10. CONTRIBUTION LICENSE

By posting Contributions, you grant the license described in Section 2 and waive any moral rights to the extent permitted by law. You retain ownership of your Contributions. We may edit, re-categorize, pre-screen, or delete at any time.


11. GUIDELINES FOR REVIEWS

Reviews must reflect firsthand experiences, avoid profanity/discrimination/illegal references, not be false/misleading, and not be posted by competitors or coordinated campaigns. We may accept, reject, or remove reviews at our discretion.


12. THIRD-PARTY WEBSITES AND CONTENT

We are not responsible for third-party sites or content, including their accuracy, policies, or practices. Your use of third-party resources is at your own risk. We do not endorse third-party products/services.


13. ADVERTISERS

We may display ads. We provide space only and have no other relationship with advertisers.


14. SERVICES MANAGEMENT

We may monitor the Services, enforce these Legal Terms, restrict access, remove burdensome files/content, and operate the Services to protect our rights/property and ensure proper functioning.


15. PRIVACY POLICY

See our Privacy Policy: https://bobberbargain.com/pages/privacy-policy. The Services are hosted in the United States. By using the Services, you consent to processing in the U.S.


16. TERM AND TERMINATION

We may deny access to the Services, block IPs, suspend/terminate accounts, and remove content at any time for any reason, including breaches of these Legal Terms or law. You may not register again if your account is terminated. We may pursue legal remedies.


17. MODIFICATIONS AND INTERRUPTIONS

We may change, suspend, or discontinue any part of the Services without notice and are not liable for unavailability or downtime. We have no obligation to update information.


18. GOVERNING LAW

These Legal Terms and your use of the Services are governed by the laws of the Commonwealth of Pennsylvania, without regard to conflict-of-laws principles.


19. DISPUTE RESOLUTION

Informal Negotiations. Before filing a claim, the parties will attempt to resolve disputes informally for 30 days after written notice.

Binding Arbitration (U.S. Consumers). If unresolved, disputes will be finally resolved by binding arbitration under the American Arbitration Association Consumer Arbitration Rules (the “AAA Consumer Rules”). Fees will be allocated per the AAA Consumer Rules. The arbitration may be conducted in person, by documents, by phone, or online. Unless required otherwise by the AAA Rules or law, the arbitration will occur in Allegheny County, Pennsylvania. The arbitrator must apply applicable law, issue a written decision, and judgment on the award may be entered in any court with jurisdiction.

Small Claims; IP/Equitable Relief. Either party may bring qualifying claims in small-claims court or seek injunctive/equitable relief for IP or unauthorized use/privacy violations.

Class Action/Jury Waiver. To the fullest extent permitted by law: arbitration is individual only; no class actions or representative proceedings; and you waive the right to a jury trial.

Time Limit. Any claim must be filed within one (1) year after it arose, or be forever barred (unless a longer period is required by law).

If any part of this Section is found unenforceable, that portion will be severed and the remainder enforced; if the class-action waiver is unenforceable, this Section 19 is void as to that dispute.


20. CORRECTIONS

Information on the Services may contain errors or omissions (including product descriptions, pricing, and availability). We may correct or update at any time without notice.


21. DISCLAIMER

THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not warrant uninterrupted or error-free operation, or the accuracy/completeness of content. You use the Services at your own risk.


22. LIMITATIONS OF LIABILITY

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE AND OUR DIRECTORS, OFFICERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, CONSEQUENTIAL, EXEMPLARY, INCIDENTAL, SPECIAL, OR PUNITIVE DAMAGES, OR LOST PROFITS/REVENUE/DATA, ARISING FROM OR RELATED TO YOUR USE OF THE SERVICES, EVEN IF ADVISED OF THE POSSIBILITY. OUR TOTAL LIABILITY FOR ANY CLAIM WILL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM. Some jurisdictions do not allow certain limitations; some of the above may not apply to you.


23. INDEMNIFICATION

You will defend, indemnify, and hold harmless us and our affiliates and their officers, agents, partners, and employees from and against any losses, liabilities, claims, and expenses (including reasonable attorneys’ fees) arising out of: (1) your Contributions; (2) your use of the Services; (3) your breach of these Legal Terms; (4) your violation of third-party rights; or (5) your harmful acts toward other users. We may assume exclusive defense/control of any matter; you will cooperate at your expense.


24. USER DATA

We may maintain data you transmit for performance/operation of the Services. You are responsible for backing up your data. We are not liable for loss/corruption of data.


25. ELECTRONIC COMMUNICATIONS, TRANSACTIONS, AND SIGNATURES

By visiting the Services, emailing us, or completing online forms, you consent to receive electronic communications. You agree that electronic agreements, notices, disclosures, and other communications satisfy any legal writing requirement. You consent to e-signatures and electronic records.


26. SMS TEXT MESSAGING

Program. Bobber Bargain Alerts. By opting in, you agree to receive SMS messages (e.g., order/status updates, customer support).
Consent. Consent is not a condition of purchase.
Opt-Out. Text STOP to cancel. You may receive a confirmation text.
Help. Text HELP for help or contact support@bobberbargain.com or (855) 822-5535.
Msg & Data Rates. May apply; frequency varies.
Carriers. Carriers are not liable for delayed or undelivered messages.
Privacy. See our Privacy Policy for how we handle your data.


27. CALIFORNIA USERS AND RESIDENTS

If a complaint with us is not resolved, you may contact the California Department of Consumer Affairs, Consumer Information Division, 1625 North Market Blvd., Suite N-112, Sacramento, CA 95834; (800) 952-5210 or (916) 445-1254.


28. MISCELLANEOUS

These Legal Terms and posted policies constitute the entire agreement between you and us regarding the Services. Our failure to enforce any right is not a waiver. We may assign our rights/obligations. We are not liable for delays beyond our reasonable control. If any provision is unlawful or unenforceable, it will be severed and the remainder enforced. No agency, partnership, joint venture, or employment is created by these Legal Terms. You waive any defenses related to the electronic form or lack of signatures.
